Appeal by the claimants Railtrack plc (R) from a LT decision (Con/153/2000, 23 July 2001) that the respondent (G) should pay £5m for the air rights necessary to allow it to build a road across railway lines owned by R, so that G could provide access to a development at Park Royal on land it owned in West London.
