[2003] EWCA Civ 208, 2003. Appeal by the landlord (Z) from a decision that he was not entitled to oppose the grant of a new business tenancy to the respondent tenants (P) under the Landlord and Tenant Act 1954 s30(1)(g). Z's grounds for opposing the application were that he intended to occupy the premises for carrying out his own restaurant business. Z appealed that it was not clear whether the judge had held that he had no genuine intention or whether he had a genuine intention but could not carry it out. "Held", the appeal was dismissed.
