Uncovering a provision to make the adjudicator's decision final

Uncovering a provision to make the adjudicator's decision final - 2003 - Architects' Journal 217(12) 27 March 2003, 40(1) .

Looks at the provision in the Housing Grants, Construction and Regeneration Act 1996 which enables disputing parties to agree that an adjudicator's decision will be final. This would save time and the cost of a second round in the courts. In "Ferson Contractors v Levolux AT" ([2002] EWCA Civ 11, Abs66318) Ferson appealed against an adjudicator's decision but the decision was upheld, thereby supporting the original clause in the contract and reinforcing the intention of the clauses.
