Discusses a recent decision "Lloyds TSB Bank plc v Edward Symmons and Partners" ([2003] EWHC 346 (TCC), Abs66654) in which the HC rejected the bank's (L) claim for damages for an alleged negligent valuation carried out by (E). "Merivale Moore plc v Strutt and Parker" (CA WB3517-20) applied. Claim rejected on the grounds that the valuation was within the permissible margin of error. In order to succeed with negligence claim against a valuer it is necessary to show that the valuation was outside the 'margin of error'. If it is, this is itself evidence of negligence.
