[2003] EWCA Civ 160 24 January 2003. Claimant's (M) appeal from the order of the Lands Tribunal (LT) on 31 May 2002 on a preliminary issue arising out of a notice of reference to determine the amount of compensation to be paid to the claimant under the Land Compensation Act 1973. LT held that use of premises by M did not involve a sharing of occupation and so there had been no breach of covenant. The council appealed. "Held", the appeal was dismissed.
