A High Court ruling that allows local authorities to prosecute water companies for failing to control sewage smells could mean they are left with a huge bill. The two High Court judges ruled that for the first time odour nuisance from water company sewage treatment works should be controllable under the Environmental Protection Act 1990. The High Court decision overturns a recent magistrates court ruling that prevented the London Borough of Hounslow from prosecuting Thames Water.
