RA/53/2001, 8 April 2003. Appellant (O) a licensed telecommunications operator under the Telecommunications Act 1984 was entitled to locate its apparatus on the public highway free of charge. O appealed against a Valuation Tribunal decision assessing the rateable value of the land at £1 100 on the grounds that its entitlement also extended to free rateable value. The LT held that the right of a telecommunications operator under the Telecommunications Act 1984 Sched 2 para 9(1) to locate his equipment in the highway without payment is to be disregarded in rating valuation. "Poplar Assessment Committee v Roberts" ([1922] 2 AC 93) applied. Appeal dismissed.
