Discusses "Marcq v Christie Manson and Woods Ltd" ([2003] EWCA 731, Abs66753) which poses the question as to whether an auctioneer (acting in good faith) is liable in conversion or bailment to the owner where an unsold painting is returned to a prospective seller who is not the true owner. CA upheld C's claim that it had acted in good faith and dismissed claim for conversion and bailment (see also WB3921-01).
