Discusses "Tomlinson v Congleton BC " ([2003] UKHL 47, Abs67008), in which the HL in overturning the CA decision (WB3812-13) held that an occupier is under no duty to protect trespassers against the ordinary and obvious dangers involved in swimming in a lake. Trespassers are deemed to be responsible for their own foolhardy actions.
