Second in a series of articles covering construction law which looks at the development of collateral warranty agreements and how they grew out of the need to provide third parties with contractual rights in respect of underlying construction contracts to which they were not a contracting party. Examines when a collateral warranty agreement is necessary and whether they are enforceable. Concludes they serve an important purpose in commercial property developments.
