In a case involving the London Borough of Newham and three tenants of Newham Council it was decided that the Unfair Terms in Consumer Contract Regulation (UTCCRs) did apply to tenancy agreements and other contracts relating to a transfer of an interest in land. The council had claimed that the UTCCRs did not apply to this area and the tenant was not a consumer. Permission to appeal was given to the Borough of Newham on the grounds that the case raised issues of public interest.
