Examines in detail the concept of digital signatures in electronic conveyancing as laid down in the Land Registration Act 2002 s91. Sets out the statutory background, explains what digital signatures are and how they are used, describes the security issues arising out of their use and discusses the legal implications of possible security failures. Concludes that practitioners should scrutinise very carefully the proposals that HM Land Registry will make as to the conditions to govern access to an electronic conveyancing system, as to the security requirements to be imposed on users and as to how risks of forgery will be allocated (expressly or by implication).
