Discusses a recent case "Tennaro Ltd v Majorarch Ltd" ([2003] EWHC 2601 (Ch), [2003] 47 EG 154 (CS)) which raises a number of issues concerning a contract of sale. Concludes that where a seller could have proceeded with the agreed sale or with a resale without incurring losses, a case can be made for the return of the deposit.
