Simon Richard Fraser and Nathan George Fraser v Canterbury Diocesan Board of Finance and Integrated Services Programme
- 2004
[2004] EWCA Civ 15, 28 January 2004. Appeal by appellant F against a HC decision ([2003] EWHC 1075 (Ch), 14 May 2003) which held that a reverter of land had not taken place before the Reverter of Sites Act 1987 came into force. CA held that the trustees of an 1866 trust deed were entitled to the proceeds of the sale of part of the site of a school since the land had reverted to the successors in title of the grantor under the School Sites Act 1941 s2 on the grounds that there had been a cessation of the purpose stipulated in the trusts on which the land had been donated for use as a school. Appeal allowed. View judgment at www.courtservice.gov.uk.
