Referring disputes to adjudication

Klein, H.

Referring disputes to adjudication - 2004 - Civil Engineering Surveyor December/January 2004, 18-19(2) .

Reviews the adjudication process and the reasons why construction contract disputes may be referred to it. Looks at "Construction Centre Group Ltd v Highland Council" (CA127/02, X12136) where Highland Council, attempting to avoid paying the Construction Centre Group in accordance with an adjudication decision, following its failure to correctly refer a dispute that it required to be dealt with by an adjuidicator, sought to withhold monies awarded in the adjudication decision based upon statute law dating from 1592. Different parts of the dispute were heard separately, which unnecessarily delayed the process.
