Use of private rights of way

Sydenham, A.

Use of private rights of way - 2004 - Farm Tax Brief 19(1) February 2004, 7-8(2) .

Considers the use of private rights of way using case law and the issue of whether a right of way could be used to access a non-dominant tenement where the use of that land was ancillary to the use of the dominant tenement. Cases used to illustrate the inconsistent approach to this issue include "Peacock v Custins" (CA, Abs63791), "Das and others v Linden Mews Ltd" ([2002] EWCA Civ 590, Abs65673), "Massey and another v Boulden and another ([2002] EWCA Civ 1634, Abs66173) and "Macepark (Whittlebury) Ltd v Sargeant and another" [2003] EWHC 427(ch), Abs67212.
