Discusses "First Penthouse Ltd v Channel Hotels and Properties (UK) Ltd" ([2003] EWHC 2713 (Ch), Abs67353) which highlights the lack of clarity the Landlord and Tenant (Covenants) Act 1995 provides on the concept of personal covenants. Argues that where there is no overriding lease, the Act does not provide any clear indication of who can enforce tenant covenants.
