Discusses "Sykes v Taylor-Rose and another" ([2004] EWCA Civ 299, Abs67660) which upheld the principle of caveat emptor by maintaining that the defendant did not have a positive duty to disclose that there had been a murder at the house several years before. CA ruled that the defendant has answered the claimants preliminary enquires about the property in an honest fashion.
