Discusses the effect of the case, "Van de Walle V Texaco Belgium SA"([2004] EUECJ C-1/03) on government plans to redevelop brownfield sites. Petrol had been leaked accidentally into the ground and the court ruled that the petrol should be considered as waste even while it remained undisturbed in the ground. Such a ruling could lead to contaminated sites being reclassified as waste dumps.
