Discusses the implications for contaminated land following the European Court of Justice ruling in "Walle and others v Texaco Belgium SA" ([2004] EUECJ C-1/03). In Walle the ECJ ruled that the petrol spillage should be considered as waste even while it remained undisturbed in the ground. The case has potentially increased the scope of the EU directive on waste (Directive 75/442/EEC).
