Addresses worrying issues concerning the notice of potential liability of costs introduced in the Tenements (Scotland) Act 2004 s12(3), which is a new registerable event and document relating to whether and to what extent a flat purchaser in a tenement should be liable for common charges incurred or proposed prior to the purchase. Examines the legal and contractual background to actual or potential common charges in the context of a sale of a flat, scrutinises s12(3) in detail and looks at the missives provisions. Concludes that with this new provision yet another potential pitfall has been introduced into the conveyancing process for which practitioners will have to provide.
