Discusses the proposal for a directive on mediation in civil and commercial matters. The objective of this directive is to facilitate access to dispute resolution by promoting the use of mediation and ensuring a sound relationship between mediation and judicial proceedings. Argues that it will have little effect on disputes appearing before English courts as the current policy of attempting to resolve disputes by alternative dispute resolution is already an established part of the dispute resolution landscape.
