Examines the issue of setting up mobile phone masts in the vicinity of schools. Government guidance in the form of PPG8 is more cautious and states that operators should carry out a pre-application consultation exercise with schools and colleges to enable concerns to be raised and discussed. However,"T-Mobile (UK) Ltd and others v First SoS and another" ([2004] EWCA Civ 1763, The Times 16 November 2004) and "St Leger-Davey v First SoS" ([2004] EWCA Civ 1612, Abs68565) upheld plans to site base stations near schools and show that, for the foreseeable future, operators will be able to build masts next to schools despite public concerns over health issues.
