Developers considering purchasing vacant land now need to consider a further issue in addition to all the other factors potentially affecting development land: the right to roam. Whilst this is not strictly speaking a new right - it was created by the Countryside and Rights of Way Act 2000 - it is only relatively recently that commencement orders have been made to bring areas of the country into the regime and therefore it is only recently that the need to do a right to roam search has begun to be appreciated by practitioners.
