Discusses the issue raised in "South Tyneside BC v Wickes Building Supplies Ltd" ([2004] EWHC 2428 (Comm), unreported) where a witness summons was issued in order to gain details of a lease. Witness summons can compel a party to provide sensitive information but, in some cases, a confidentiality clause can be set aside. A confidentiality clause does not in itself render a transaction irrelevant as evidence in a rent review arbitration.
