2 March 2005, QBD. An enforcement notice had been served against a gypsy (S) using green belt land for his caravans. An inspector was appointed following S's appeal but found there was a lack of alternative sites and upheld the apeal. "Held": the SoS's decision to uphold the enforcement notice was successfully challenged on the grounds that the SoS had failed to consider evidence showing S had looked for alternative sites.
