Generay Ltd v Containerised Storage Company Ltd - 2005

[2005] EWCA Civ 478, 23 March 2005. Considered an appeal by the Containerised Storage Company (C) against a decision that Generay (G) had acquired the title to a strip of land by way of adverse possession. C argued that G had excluded itself from the land by putting up a tape fence around part of the land for three months (in relation to unrelated litigation). "Held": G had established title over all the strip of land except for the taped off area subject to the outcome of the dispute concerning that area. It was also decided that G's self exclusion from the taped off area amounted to interruption of possession sufficient to defeat adverse possession.
