In Aberdeen Harbour Board v Heating Enterprises (Aberdeen) Ltd and Others, Outer House of the Court of Session 2 March 1988, the point at issue concerned the construction of JCT 1963 cl. 20(c) . It was held that the employer did not have to insure against liabilities of the contractor or subcontractor to third parties arising out of their negligence .
