Reports on the Contracts (Rights of Third Parties) Act 1999 which provides an alternative to collateral warranties. The Act enables a funder, tenant or buyer of a new development to enforce key parts of the building contract between the developer and the main contractor. This gives funders, buyers and tenants a guarantee that they could claim damages from the main contractors and their subcontractors for defects that emerge some years after the completion of the job.
