Discusses the case "Willis Management (Isle of Man) Ltd v Cable and Wireless plc and Pender Insurance Ltd" ([2005] EWCA Civ 806). It involved a fraudulent scheme by an underwriter at Willis (W) and staff at Cable and Wireless to divert premium income from Pender (P) into companies they owned. W agreed to co-operate with the investigations. The court had to consider whether to uphold this agreement. However, in line with previous cases, the agreement was not enforced by the court.
