Discusses the case Emson Contractors Ltd v Protea Estates Ltd ORC 31 July 1987, (see Abstract 38397), where a dispute arose as to whether or not certain foundation works were a variation within clause 13 of JCT 1980 contract, entitling Emson to additional payments, and which centred around the delay in appointing an arbitrator and a misplaced final certificate .
