A major source of problems for owners under JCT contracts is in nominated subcontracting, as the appellate courts, when interpreting ambiguous or obscure provisions, have given way to instincts of sympathy for main contractors in cases where nominated subcontractors have defaulted on obligations and because of the draftmanship of contracts. This article discusses the point in the light of reported cases.
