[2005] EWCA Civ 814, 16 June 2005. Considered the issue of the application of the Limitation Act 1980 to payment claims. H appealed against an arbitrators decision that its claims for payment were statute barred as work and events on which the claims were based had occurred more than six years earlier. "Held": the appeal appeal was allowed in part on the grounds that B's right to payment arose when the a payment certificate was issued or ought to have been issued under cl60 and not when the work was done.
