Discusses the case "Birse Construction Ltd v McCormick (UK) plc" ([2005] EWCA Civ 940, unreported) which concerned the date of accrual of a cause of action for sums due under a contract. The case showed that this depended on the terms of the contract itself, and that where the contract provided for monies claimed to be resolved by formal amendment to the contract, the cause of action would normally arise when the claim for those monies was first presented.
