[2005] EWHC 1710 (Ch) 29 July 2005. Case involving a dispute over the right of way between the owners of a house on an estate and the estate owner. W claimed an injunction against L on the grounds of excessive use of the road, and damages for trespass. The court had to decide whether this was valid. "Held" the court agreed that the right of way could not be used to access land that was not originally part of the estate at the time of the right of way being drawn up but could be used to access dwellings on the estate regardless of whether they were being used for the purpose of the estate. The use of the right of way was valid for commercial shoots, as these were run in connection with the running of the estate.
