In Richards v British Coal Corporation , LT 22 April 1988, the occupier brought a claim under the Coal Mining (Subsidence) Act 1957 against the Corporation alleging damage to his property. There was evidence of other causes and the Corporation had to establish that the damage was not attributable to coal mining.
