Looks at the implications for the construction industry of new Practice Direction 31 of the Civil Procedure Rules, which deals for the first time with the disclosure of electronic documents in civil proceedings. Consideration must now be given to the way such documents are generated, how and where they are stored, and how long they should be retained. A document management and retention procedure, and proper archiving policy, should be put in place.
