Case news: "Shirayama Shokosan v Danovo" - 2005 - Property Week 70(45) 11 November 2005, 74(1) .
In this case (ChD, unreported), a tenant habitually broke the terms of his lease and was eventually evicted following a court ruling. The gallery owner used space he was not renting without consulting the landlord; and sold concessionary tickets, which affected the profit-based rent. Previous breaches which resulted in other litigation had already put a great strain on the landlord-tenant relationship. This case highlights the fact that court has sole discretionary power to decided whether or not a tenant maintains their lease, based on their conduct; even if the tenant agrees to take steps to remedy the situation.
