Describes the facts of, and comments upon, "Shawton Engineering Ltd v DGP International and others" ([2005] EWCA Civ 1359, unreported). S terminated D's subcontract on the grounds of delay, even though S accepted that D was entitled to complete its work within a reasonable time. It was held that where work was required to be completed on this basis, the reasonable time for completion must be established, and notice making time of the essence must be served before the contract could be terminated on the grounds of delay.
