Reports the facts of, and comments upon, Huseyin Akici v L R Butlin Ltd ([2005] EWCA Civ 1296, L132172), where inadequate drafting of a notice under s146 of the Law of Property Act denied the landlord, B, the remedy of forfeiture. Warns that landlords must draft s146 notices very carefully, quoting from the lease the particular breach complained of. New leases should contain comprehensive alienation clauses preventing the tenant parting with or sharing occupation or possession.
