Suggests that the reforms to the landlord's hypothec and sequestration for rent contained in the Bankruptcy and Diligence etc (Scotland) Bill merit clarification and reconsideration. Considers in detail s194 of the Bill which will radically alter the landlord's hypothec, a long established security over moveable property, as well as abolishing sequestration for rent, the diligence by which that security is enforced. Regards the provision as currently framed to be problematic.
