Gives the facts of, and comments upon, "Scheldebouw BV v St James Homes (Grosvenor Dock) Ltd" ([2006] EWHC 89 TCC, unreported), where the question to be decided was whether the defendant could dismiss its construction manager midway through a project and assume the role itself. After reviewing the role of the construction manager and previous case law, the court held that whilst the defendant had the power to dismiss and replace a contract manager, it could not appoint itself to this role.
