Second of a three-part series examining the changes to the JCT suite of contracts. This article discusses the JCT Design and Build Contract 2005 (DB05). As well as incorporating a number of amendments that were commonly made by practitioners to the previous form of contract, DB05 clarifies responsibility for design problems and issues surrounding payment applications and withholding notices. It also provides that the employer defines the site boundaries.
