Reports the facts of, and comments upon, "Quietfield Ltd v Vascroft Ltd" ([2006] EWHC 174 TCC, L132952), where it was decided that a contractor, in adjudication proceedings may rely, by way of defence for a claim for damages, upon an alleged entitlement to an extension of time, regardless of whether that entitlement has been notified to the referring party. A contractor cannot, however, rely upon an alleged entitlement which has been considered and rejected in previous adjudication proceedings.
