Possession orders

Holbrook, Jon

Possession orders - 2006 - Solicitors' Journal 150(10) 17 March 2006, 323-326(3) .

Considers the problems posed by the making of suspended possession orders in the light of the decision in "Ealing LBC v Richardson" ([2005] EWCA 1798, unreported) when the CA allowed the defendant to stay in her home despite having breached the terms of a suspended possession order made nine years earlier. Outlines a series of steps that can be taken to prevent this state of affairs, covering matters up to the making of a possession order, after an order has been made, and the situation if judgment is suspended.
