Gives the facts of, and comments upon, "Scheldebouw BV v St James House (Grosvenor Dock) Ltd" ([2006] EWHC 89, TCC, L132871), where the developer dismissed the construction manager, and attempted to appoint itself to this role. It was decided that, as part of the function of a construction manager was to act independently and fairly between employer and contractor, it was not appropriate for a developer to unilaterally act as its own construction manager.
