Clause for concern
Fox, Alisdair
Clause for concern - 2006 - Journal of the Law Society of Scotland 51(4) April 2006, 47(1) .
Considers the statutory landlord registration scheme under the Antisocial Behaviour Etc Scotland) Act 2004 to be inconsistent and confusing in its application to properties included in an agricultural tenancy. The farmer will be registered but it is difficult to understand why the owner requires to register. Suggests that it would be better if the tenant farmer registered any property to be subletted or provided under the terms of any employment contract with no further obligation being placed on the owner as a result of the farmer's actions. However as the regime is coming into force at the end of April 2006 it is too late for modifications and the interpretation of the Act's inconsistencies wil now be a matter for the courts.
