Examines some common misconceptions about the role of the mediator, and argues that whilst there is no reason why judges cannot be effective mediators, they require the necessary knowledge, skills and training, and need to possess the right aptitudes. The critical point is that as mediators are not judgmental, a judge, arbitrator or adjudicator acting in that capacity must remove his judicial hat; if he is unable to do so, he will fail as a mediator.
