[2005] EWHC 2356 (TCC) 31 October 2005. P awarded a contract to D to carry out building works. P later asserted that the contract did not accurately reflect what had been agreed between the parties, specifically on issues concerning date of formation of the contract, which documents were incorporated in the contract, the relevant dates for performance, and contractual working hours. An arbitrator found against P on all four issues. P sought leave to appeal under the Arbitration Act 1996 s69. "Held" the issues raised by P related to errors of fact, not law. Even if there had been an error of law, it did not substantially effect the rights of the parties. Nor had P been able to show that there had been an obvious error on the face of the arbitrator's award itself; indeed the arbitrator had almost certainly been right on every issue. Permission to appeal was refused.
