[2006] EWHC 331 Ch, 8 March 2006. Declaration sought by S that P were not entitled to the benefit of covenants set out in a schedule to the conveyance of a property of which S was the freehold owner. "Held": declaration granted. The covenants had been intended to enable S's predecessor in title H to retain control as long as she was the owner of the land unsold. If a piece of land was sold the benefit of the covenant ceased to be annexed to that land unless expressly assigned. As all the land had been sold by H and there had been no express assignment, S was entitled to the declaration sought.
